As much as we don’t like legalese, this stuff is really important

Please read it and don’t hesitate to ask any questions that you might have about anything contained here.

 

All items that are brought into this store for any reason are subject to all of the terms and conditions described below.  Store employees can not change these terms under any circumstances.


Because we are not certified or licensed to do so, we do not accept any hazardous, illegal, prohibited, dangerous or restricted materials, including, but not limited to the following:

  • Flammable / inflammable such as gasoline, alcohol, perfume, oil, paint, matches, acetone, toluene, turpentine, Sterno ®, Butane, Propane other flammable chemicals, etc.)
  • Compressed gasses such as gas shock absorbers, aerosol spray cans, oxygen / gas cylinders (unless verified empty by removing the valves and/or regulators)
  • Explosives, fireworks, matches, cigarette lighters, ammunition, gunpowder
  • Dangerous items, toxic chemicals, corrosive, acids, caustic, oxidizers, poisonous, pesticides, bleach, etc
  • Radioactive items, biological samples (including all “Lab Packs”), biohazard or any container labeled “ORM-D”
  • Restricted items – firearms, firearm parts, beer, wine, other alcoholic beverages, tobacco, cash, items valued at or over $10,000, or any item that is illegal to possess or ship.
  • Perishable items are shipped at your sole risk.  Neither Postal Center USA nor the carriers assume any liability of any kind for perishable items.

By dropping off or shipping your item through Postal Center USA, you warrant that the contents are not hazardous or restricted under these or any other definition, and that you have completely and accurately disclosed the contents of your package.  If you are in doubt about whether your items are dangerous to ship, please ask us for help.  We will consult the carrier’s Hazardous Materials Hotline at no cost to you.

 

Violations of Federal Hazardous Materials regulations (CFR parts 171-180) can result in fines to you of up to $250,000 and up to 5 years imprisonment as well as civil litigation by us against you.

 

Right to inspect.  Postal Center USA reserves the right to inspect all packages that are brought to this store for any reason.  Law Enforcement will be notified if hazardous, illegal, dangerous, prohibited or restricted items are found, and a minimum $50.00 processing fee, plus actual expenses will be charged by us to you before your item is returned.

A signature on delivery is available (at extra cost) on all domestic packages sent via UPS and FedEx.  If you do not ask for a signature on delivery and the recipient is not available to receive the package, the delivery driver may leave the package at the doorstep or other location.  If the package is then stolen, neither the carrier nor Postal Center USA will honor a claim for loss.

Customer Packed Items.  Items that are not packaged by Postal Center USA are covered by “declared value” only in the event that they go completely missing. 

The “declared value” will not be honored for claims resulting from damage to your items during the shipping process.  If you want damage in shipping to be covered by the “declared value”, they must be packed by Postal Center USA.

Shipping Damage.  In the event of shipping damage it is absolutely essential that the recipient retain all packaging materials and that all instructions from us and the carrier are followed completely – otherwise, it is very likely that your claim will be denied.  If a claim is paid, you may be required give up possession of the item and be required to ship it back to us or to the carrier.

Declared Value.  If you declare less than the full value of the item you will likely incur a “co-insurance” penalty that will result in your payment being substantially reduced from the amount of coverage that you purchased. 

We strongly recommend declaring the full, true value of all items.  Postal Center USA is not liable for losses you suffer due to “co-insurance” penalties.

Time is of the Essence.  If you file a claim due to loss or damage, all information requested must be provided within 7 days or the claim may be denied. 

Proof of Value & Affidavit.  If you file a claim due to loss or damage, you will be required to provide proof of value for the items claimed.  You may also be required to provide a notarized affidavit regarding the items and their value.  This is a sworn statement made under the pains and penalties of perjury.

Final Determination on losses.  In all cases of loss or damage, the determination of the shipping carrier and/or the 3rd party insurance carrier are final.  Postal Center USA is not liable for additional payment under any circumstances whatsoever.

Postal Center USA not liable.  Postal Center USA is not liable for any part of losses (direct, indirect, consequential and all others) suffered due to shipping damage, loss, delay or any other cause under any circumstances.

Wrong addresses.  Postal Center USA is not liable for wrong addresses or any incorrect information provided by you.  If we incur additional charges for address correction, we will charge you additional fees which you agree to pay promptly.

Ground service is not guaranteed. We do not offer on-time guarantees or refunds on any Ground service, including UPS, FedEx Ground, Greyhound Package Express and all USPS services. 

Because conditions beyond their control may delay your shipment (weather, strike, act of God, national or local emergency, etc.) carrier determinations regarding exceptions to other on-time guarantees (such as express shipments) are final.

Not Shipped on Our Account (pre-paid drop-offs):  Packages shipped on somebody else’s account are accepted by us as a courtesy to you.  We accept absolutely no liability of any kind for these packages, nor do we provide or retain tracking information.  However, you retain full liability for hazardous, illegal, dangerous, prohibited or restricted items brought to our store by you.

Abandoned, Returned, Restricted Items.  All items that are abandoned, returned to us because of any type of incorrect information, dropped off without a paid shipping label, returned due to refused delivery or held because our inspection reveals hazardous, illegal, prohibited, dangerous or restricted items will incur a storage charge of $5.00 per package per day. 

Items not picked up within 60 days will be discarded with no reimbursement to you.

Disputes.  All disputes will be settled in the jurisdiction of Massachusetts and through arbitration by qualified members of The American Arbitration Association.
